General Terms and Conditions (GTC) of Bauvorschau GmbH Sudetenstraße 39, 91096 Möhrendorf, Germany (hereinafter "Provider") for the use of the online software at www.supergrundriss.de (hereinafter "Software" or "Service")

These GTC apply to all contracts between Bauvorschau GmbH and natural or legal persons (hereinafter "Customer" or "User") regarding the use of the Software, which enables users to design floor plans online and convert them into attractive, professional layouts. Deviating terms and conditions of the Customer shall not be recognized unless the Provider expressly agrees to them in writing.
2. Services of the Provider
The Provider makes the Software available to the Customer as a web-based application. The Software serves exclusively as a tool for creating and editing floor plans. Further consultation, architectural or building law review of the created floor plans is not part of the contract.
Use of the Software requires registration. Registration is currently only permitted for business entities (entrepreneurs).
Upon completion of registration and confirmation of these GTC, the usage agreement is concluded. The Provider reserves the right to reject registrations without stating reasons.
The Customer receives a simple, non-transferable right to use the Software within the scope of the selected pricing tier. Prices and contract terms are determined by the current price list on the website www.bauvorschau.com. Payments are due in advance.
The Provider supplies exclusively the tool. It makes no claims to copyright or any other proprietary rights in the floor plans or other content created by the Customer using the Software.
The Provider is neither able nor obligated to determine who holds the copyright in the created works. The Provider assumes and expressly agrees that the Customer obtains an unrestricted, irrevocable and exclusive right of use (including the right to reproduce, edit, distribute and make publicly accessible, including for commercial purposes) in the floor plans created by them. The Customer is solely responsible for ensuring that they hold all necessary rights to any templates, images or other materials they use.
The Customer undertakes to use the Software only in accordance with applicable laws and not for unlawful purposes. They bear sole responsibility for the floor plans they create and their legal permissibility (e.g. compliance with building regulations).
The Provider's separate privacy policy applies, available at www.bauvorschau.com/datenschutz (or corresponding link).
The Provider is liable exclusively for intent and gross negligence. Liability for slight negligence is excluded to the extent permitted by law. This applies in particular to damages arising from the use or unavailability of the Software, for incorrect or incomplete floor plans, and for indirect or consequential damages. Liability under the Product Liability Act and for injury to life, body or health remains unaffected.
The contract runs for an indefinite period or for the selected term. It may be terminated with 14 days' notice to the end of the month. The right to extraordinary termination for good cause remains unaffected.
The Provider is entitled to amend these GTC with effect for the future. The Customer will be notified by email or within the login area. If the Customer does not object within 30 days, the amended GTC shall be deemed accepted.
(1) Applicable Law
The law of the Federal Republic of Germany applies exclusively. The United Nations Convention on Contracts for the International Sale of Goods (UN Sales Law / CISG) is expressly excluded.
(2) Jurisdiction
If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is the registered office of the Provider (Möhrendorf, or the Local Court of Fürth).
(3) Dispute Resolution The Provider is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board pursuant to EU Regulation No. 524/2013 (ODR Regulation).
(4) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall not be affected.
